Judges oppose provision on enforcing verdicts

ADMINISTRATIVE Court judges yesterday unanimously voted to oppose a provision in the draft charter giving the Office of the Judiciary responsibility for enforcing the court's orders and verdicts.

Their plenary meeting agreed that the job was best left to the Office of the Administrative Court, due to its expertise and experience. Administrative Court rulings also include payments for damages.
The change was made by the Constitution Drafting Committee (CDC) on February 20. 
The plenary meeting ran for three days in Rayong province and finished yesterday. The judges argued that the move by the CDC violates the principle of parallel and separate structures of the Courts of Justice and the Administrative Court that was enshrined in the charters of 1997 and 2007.
 
Different methods of 
adjudication
The principle reflected their fundamentally different methods of adjudication. 
The Administrative Court practices the inquisitorial system for cases to ensure maximum justice while the Courts of Justice relies on the accusatorial or adversarial |system.
