Department of Special Investigations chief Tarit Pengdith, secretary of the CAPO, said the Constitution allowed the court to oust only Prime Minister Yingluck Shinawatra if it rules that her order to remove Thawil Pliensri as the NSC chief was unconstitutional.
Tarit said the court had no authority to oust the Cabinet because of Yingluck’s order because Article 181 would require the Cabinet to become the caretaker government after the prime minister is disqualified.
Tarit said if the court goes beyond its authority to oust the Cabinet, the government should invoke Article 7 to ask His Majesty the King whether the Cabinet should go on administering the country as the caretaker administration.
