On September 27, the lower court convicted Jatuporn for defaming Abhisit during red-shirt rallies in January and February 2010 by accusing the Democrat leader, who was prime minister at that time, of ordering troops to kill the people.
The lower court sentenced Jatuporn to six months in jail and a fine of Bt50,000 but it suspended the jail term and put Jatuporn on probation for two years.
Abhisit appealed against the sentence, asking the court to jail Jatuporn instead of suspending the imprisonment.
The Appeals Court refused to cancel the suspension of the jail term, saying the defamation committed by Jatuporn did not cause severe damages to the plaintiff.
