The suit alleged that Chirmsak defamed King Power and damaged its reputation and business by alleging during his TV prgramme on NBT channel on February 10 2010 that it sold tax-avoidance goods.
The primary court ruled in favour of Chirmsak, saying he had proved his allegation with a video clip. And the Appeals Court has later rejected the suit on ground that Chirmsak made his comment with sincere intention.
On Wednesday, the Supreme Court ruled that Chirmsak simply raised his question with the then finance minister with sincere intention as a journalist. Moreover, Chirmsak was at that time a member of the board of directors of Airports of Thailand so he had responsibilities to check and protect the national interest.
