Inside AGT’s US$1m prize and contract questions for Nene Royal

Thai teenage rocker Nene Royal has advanced to the live semi-finals of America’s Got Talent Season 21 after Mel B awarded her a Live Golden Buzzer for her performance of Soundgarden’s “Black Hole Sun”.

Her progress in the US talent competition has prompted interest in what she could receive if she wins, as well as questions over how restrictive the programme’s contestant agreements may be.

How the US$1 million prize is paid

The winner of America’s Got Talent receives a prize advertised as US$1 million. However, the full amount is not normally handed over immediately as a single cash payment.

A disclaimer used by the programme states that the US$1 million is payable through a financial annuity over 40 years, or that the winner may choose the present cash value of the annuity.

Under the annuity option, the total would be divided into annual payments of US$25,000 over four decades, before tax.

The alternative is an immediate lump sum based on the annuity’s present cash value. Previous estimates have placed this at about US$300,000 before tax, although the programme’s disclaimer does not specify a fixed lump-sum amount and its value may vary.

Tax would also affect the final amount received. US-source payments to non-resident foreign nationals are generally subject to a 30% withholding regime, although a lower rate or exemption may apply depending on the recipient’s tax status, the nature of the income and any relevant treaty provisions.

Does the winner automatically receive a record contract?

Official AGT material confirms the US$1 million prize but does not state that every winner is automatically signed to a global record label.

The programme’s audition website instead notes that exposure from AGT has helped some contestants secure recording, television, Broadway and Las Vegas contracts after appearing on the show. Such deals are presented as possible career opportunities rather than a guaranteed part of the winner’s prize.

How restrictive are AGT contestant contracts?

The full Season 21 contestant agreement and any live-stage contract signed by Nene have not been made publicly available. Claims about specific first-refusal rights, exclusive management arrangements, recording options, lengthy post-show restrictions or penalties for signing with another company therefore cannot be independently confirmed.

The publicly available Season 21 online-audition terms state that contestants selected to proceed may be required to sign additional documents, including participant consent, release and arbitration provisions. Those who advance to a stage determined by the producer may also be required to sign a separate live-stage contract.

A Kom Chad Luek report claimed that producers could hold options or rights of first refusal over management, recording or performance agreements involving winners and contestants who reach the later rounds. It also claimed that exclusivity provisions could prevent them from accepting performances, producing music or appearing in other media without prior permission.

However, those specific terms do not appear in the publicly accessible online-audition documents. Their application to Nene or other Season 21 contestants would depend on the confidential agreements they individually signed.

Producers receive broad rights over audition footage

The official online-audition terms do grant producers extensive rights over videos submitted through the audition system.

Contestants provide a non-exclusive, royalty-free, sublicensable and transferable licence allowing producers to use, edit, distribute and otherwise exploit their audition videos worldwide and indefinitely across television, films, online platforms, advertising, promotion and other media.

This does not necessarily mean that producers permanently own every song, original work or future performance created by a contestant. The publicly available provision specifically concerns the submitted audition video, while rights relating to televised performances and later-round appearances would be governed by additional agreements that have not been released publicly.

Las Vegas opportunity for the winner

Besides the prize money, the AGT winner receives an opportunity to headline a show in Las Vegas. Official descriptions do not guarantee a permanent residency or specify that every winner will receive an extended run of performances, with the exact format governed by the programme’s arrangements.

For Nene, winning the competition could provide significant international exposure and open the door to further entertainment opportunities. However, the publicly confirmed prize consists principally of the US$1 million annuity or its present cash value and a Las Vegas performance opportunity, rather than an automatic global recording contract.
