Ex-auditor general Jaruwan loses posting case

The Supreme Administrative Court yesterday ruled that former auditor-general Jaruwan Maithaka did not have the authority to remove a deputy auditor-general as acting auditor-general.

The high court agreed with the Central Administrative Court that Jaruwan had lost her office when she reached the age of 65 years.

When Jaruwan was about to retire at 65, she issued an order naming Phisit Lilawachirophas as acting auditor-general. But after Jaruwan said her term could be extended past 65, she changed her mind and issued another order on August 18, 2010 revoking her previous appointment of Phisit as acting auditor-general.

Pramote Chotemongkol, chairman of the National Auditing Commission, then filed a suit against Jaruwan, arguing she had reached 65 and legally, if not physically, left her office on July 5, 2010.

The Central Administrative Court agreed with Pramote that Jaruwan had stepped down and had no right to issue the second order.
