BKK Airways wins a court case

Bangkok Airways won the court case against Koh Samui Municipality, enabling it to retrieve the household tax payments worth Bt117 million.

The Central Tax Court yesterday landed the verdict on the court case, filed by Bangkok Airways which has been subjected to the household tax payments to the municipality since 2007. The case was filed as the municipality pressured for such payments, following the airline's launch of a property fund in 2007. The fund raised Bt9.3 billion, for the 449-rai land that locates the Samui Airport. The airline later struck a 30-year leasing contract with the fund for the airport management.
The airline insisted that the property fund is part of fund mobilisation, not property leasing of which returns are subjected to household taxes.
In the verdict, the court agreed with Bangkok Airways and ordered the municipality to return the 4-year payments worth Bt117 million plus 7.5 per cent annual interest to the airline.
