The agreement was announced by both parties after the hearing of the Central Administrative Court yesterday on a petition by BEC seeking an injunction against the national broadcasting committee’s order that all cable and satellite TV networks drop Channel 3’s analog programming.
The court yesterday spent five hours hearing submissions from BEC and three members of the broadcasting committee of the National Broadcasting and Telecommunications Commission.
BEC executive vice president Surin Krittiyaphongphun along with his legal team appeared in the court, while the NBTC was represented by commissioners Peerapong Manakit, Thawatchai Jittrapanun and Supinya Klangnarong.
Originally cable/satellite networks were ordered to drop Channel 3 by September 28. BEC sought the injunction on September 26 and the court on the same day suspended the committee’s order until October 11, and told the parties to seek ways out of the problem.

SCB consultant suspended by SEC
The Securities and Exchange Commission imposed a three-month suspension on Somphol Nilsri, a securities investment consultant of Siam Commercial Bank, for signing a buy/sell order form for investment units without contacting or giving advice to a client.
The suspension resulted from his failure to perform duties or not providing services honestly, the SEC said.
After a report on a client’s complaint filed by SCB, the SEC further probed the case and found that Somphol signed the form without performing the duties of an investment consultant.
The client requested the sale of SCB Open-end Long Term Fund Dividend 70/30 in a portion that met the minimum five-year investment. A bank officer who was not an investment consultant processed the sale of investment units in a portion that did not satisfy the minimum five-year investment. The said action was a violation of conditions prescribed by the Revenue Department, causing the client to pay back tax deductions he received together with penalties.
The investigation also revealed that while the client made the request for sale of investment units, Somphol was serving another client. Without making any contact or giving any advice to the client, he signed such the sale order form in the capacity of an investment consultant. In addition, he neither examined the transaction nor requested additional information from the client or the officer who executed the sale transaction for the client.
Signing the buy/sell order form of investment units without contacting and giving advice was a failure to perform duties honestly in violation of Clause 23(1) and characteristics of personnel in the capital market business under Clause 31(1) of the Notification of Capital Market Supervisory Board No Tor Lor Thor 8/2557 re: Regulations for Personnel of Business Operators in the Capital Market dated June 3, 2014. The SEC therefore suspended Somphol from his duty as an approved securities investment consultant for three months. Because Somphol’s approved status as a securities investment consultant only lasts until December 31, 2014, his approved status was suspended until that date, while the rest of suspension period was instead set as the period for acceptance of his re-application for approval as capital market personnel, effective from October 9, 2014.
