Tawin cries foul over transfer ruling

PM's Office adviser Tawin Pleansri on Wednesday questioned the legal technicality of a civil service ruling in favour of the government for removing him from the position of National Security Council secretary general last year.

“I believe the ruling in favour of the government was unfair and might be a technical foul,” he said.
Tawin petitioned the Merit System Protection Commission, seen as a civil service court, to rule on his job transfer to an advisorty position which he said Prime Minister Yingluck Shinawatra had no justification to issue such an order.
He said his transfer was in contrary to the civil service regulations because it was executed for political expediency in order to install the new national police chief.
The government replaced him with the then national police chief General Wichean Potephosree, paving way for the promotion of General Priewpan Damapong, he said.
The commission subsequently appointed a three-member panel to vet Tawin’s petition. The panel was led by commission chairman Sarawuth Menasawet.
The panel cast a two-to-one vote to rule that Tawin had cause for claim unfair treatment. Sarawuth had a dissenting opinion and voted to side with the government.
The seven-member commission debated the panel report on Tuesday and had a split three-to-three vote on the issue. Sawaruth cast a decisive vote to dismiss the case.
Tawin said he lost the case on the technical foul since Sarawuth voted twice against him
He said he would bring his case to the Administrative Court, which will have a final say on the issue. He has 90 days to prepare his case.
