The nine former charter drafters said the 1997 charter also required senators to be elected and thus the election of senators was not an act that would topple an elected government as alleged by those who had filed petitions against charter amendments.
The nine sent their open letter to the judge two days before the court is scheduled to announce its ruling on the amendments.
The nine said the judges should make their judgement in accordance with the intention and provisions of the charter instead of making a ruling in a way that would create carnage.
The nine former charter drafters are Sawat Amornwiwat, Prachoom Thongme, Worapoj Wongsanga, Boonlert Khachayutthadej, Thongchart Ratanawicha, Sutthinan Chanthara, Wisal Kositanon, Amnuay Thaiyanon and Wutthipong Chaisang.
They also called on three judges – Charal Phakdeethanakul, Anurak Mapraneet and Supoj Khaimuk – to withdraw from the case because the three took part in drafting the 2007 Constitution and thus have a conflict of interest in the ruling.
