The case stemmed from articles written between November 22 to 23 in 2005 wherein the plaintiff, Phumtham, claimed his credibility had been affected by articles that wrongly defamed him, causing hatred against him among the public.
A verdict by the Court of First Instance gave the six editors six-month suspended prison sentences each and slapped a fine of Bt200,000. However, the Appeal Court overturned the ruling, stating the published articles were part of a media scrutiny of politicians in a bid to dissuade the plaintiff from threatening the media for its investigation into the then Thai Rak Thai government under Thaksin Shinawatra. This eventually led to the same decision by the Supreme Court yesterday.
