CDC adds transparency clause

Members of the Constitution Drafting Committee (CDC) yesterday inserted a clause to ensure that independent organisations are transparent and accountable when regulating government officials.

The article states “the public administration’s exercising of power, and the regulation of this exercising of power, should be conducted in an honest and just manner and they must be protected by an accountable and transparent regulation process that is free of conflict of interest”.
The charter drafters also discussed the new constitution’s Section 3, which is on legal principles, court and independent organisations, before they drafted the section’s Part 2 on regulating the administration.
Some members proposed that independent organisations be regulated and that measures be laid out for the legal protection of individuals investigating those in public office. However, some charter drafters said the proposed article was too long and some public offices may possess important security information that cannot be revealed, thus the proposal was scrapped with the exception of some essential parts. The drafters also discussed the issues of impeachment and political disqualification, which is one of the articles under Section 3.
Meanwhile, a new rule was proposed under which accused officials would be allowed to resign seven days after an impeachment motion is submitted, which would bring the case to a halt. However, the accused could be punished via other means, such as the criminal court. However, this proposal was met with objections because many members said it would mean that the accused could simply resign to escape the punishment of being removed from office and banned from politics for five years.
The CDC secretary said if the drafters went ahead with this proposal, they would have to explain to the public why the scale of punishment for corrupt officials had been significantly weakened from what was stipulated in the previous constitution.
CDC spokesman Kamnoon Sidhisamarn said the drafters were also discussing the framework for appointing members of independent organisations, saying they wanted the members to come from all groups of society.
