In the first case taken under the provision of the new referendum act, Somchai filed the complaint against the Khon Kaen Organization Fund with the Thung Song Hong police station at 9:05 am.
Somchai told Pol Lt Krittidej Chobkhakai, the officer in charge of the case, that the fund clearly violated the second paragraph of Article 61 of the act that carries a maximum jail term of 10 years and a fine of Bt200,000.
Somchai said in the complaint that the Facebook posts were made with foul and strong language to incite violence, and thus violating Article 61’s second paragraph.
Somchai said he saw the posts with his own eyes so he decided to file the complaint.
The EC member said it would not be difficult for police to investigate the link the Facebook page to the persons behind the posts because the page is owned by the fund that has been established as legal entity.
Somchai also handed over copies of printout of the Facebook page to police and said police would have to summon the executives of the fudn for questioning.
The EC commissioner said the executives were held responsible no matter who made the posts because the posts were public comments.
