Even if they use the emergency decree to make their actions legal, if these killings were not fully justified morally, making the truth known will pressure PM Yingluck to amend or rescind the decree, so that even state officials can and will be held accountable.
But it would be grossly unfair for the DSI, courts and society to gloss over the 12 other deaths, which may have involved red shirts, since Tharit says the weapons used in the killings were different from those issued to the military. What role did the armed “men in black” play? Why did the red shirts allow them to flit in and out of the red lines unhindered?
Justice must be even-handed. Go after all killers, not just those in the military and police.
