Yingluck and the rice case

Re: "Supreme Court to try Yingluck in rice case", News, March 20.

The charge as filed by the public prosecutor was more serious than “negligence” in failure to stop corruption and mismanagement. The legal words in the charge were: “derelict of duty unjustifiably and as a government officer discharging or absence in discharging his or her duty”. Negligence means discharging duty without prudence and due care.
Derelict of duty means abandonment of one’s allotted duty ie not doing anything at all when one has the duty to care. So, the crucial question is whether she had any duty to oversee the rice-pledging scheme or, once delegated to her minister, she has no further obligation to care.
