The tactical commander of Phakant filed a lawsuit against Ba Yan Shaung for submitting a complaint with the president and the Human Rights Commission about the death of his daughter, Jar Sai Eain, who was killed in the crossfire between the military and Kachin Independence Army in Phakant last year.
Two witnesses – Major Zarni Min Pike and Dr Kaung Myat San – were presented on the plaintiff’s side on Monday. Dr Kaung Myat San said injuries on Jar Sai Eain’s body show that a heavy weapon or a shard from a landmine had hit her.
"Even though there have been six court sessions, this is the first time that both sides have been examined. The plaintiff didn't come previously so we couldn't do anything. We'll try to find the truth. The case is still being opened now based on belief," Ywat Nu Aung, the plaintiff's lawyer, said.
Besides the president and the Human Rights Commission, the defendant also submitted a complaint letter to military tactical offices and ministries. In the letter, Ba Yan Shaung insisted that his daughter had sustained a bullet wound after being shot by the military.
The 14-year-old girl was shot on her way home from school along with ten other people during the skirmish. She was sent to hospital three hours later and pronounced dead at about 9pm.
