The ruling that was issued on December 28 was made after Thaksin’s lawyer filed the complaint against Foreign Ministry’s Consular Affairs Department as well as permanent secretary and the department’s director general for canceling his passport.
Thaksin accused them of illegally revoking his passports in May last year. In the suit it is stated that the department cited an interview Thaksin had given that it said affected national security as a reason the passports were cancelled.
Thaksin is being investigated for allegedly committing lese majeste, and allegedly violating articles 326, 328 and 14 of the Criminal Code and the Computer Act of 2007. The investigation was among other reasons given for cancelling the passports.
In the suit it is stated that Thaksin appealed the decision to cancel the passports but the department upheld the cancellations under an order dated Sept 9.
The Central Administration Court on December 28 viewed that if the Court issued the injunction on the revocation order which was administrative decision of the director general of the Consular Department and the Permanent Secretary, there could pose obstacles on the ministry’s administrative or public works.
And there is no enough reason to do as the complainer’s request, the Court ruled.
Meanwhile Thaksin’s lawyer, Wattana Tiengkul said the case against both officials are still intact pending the Court’s order.
